It’s time to play “What’s Wrong With This Picture” 07/08/2010

The Department of Justice has decided to challenge the legality of Arizona’s bill, and I want you to know at least a few things wrong with this picture.

  1. The very first thing on the legal challenge reads “In this action, the United States seeks to declare invalid and preliminarily and permanently enjoin the enforcement of S.B. 1070, as amended and enacted by the State of Arizona, because S.B. 1070 is preempted by federal law and therefore violates the Supremacy Clause of the United States Constitution.”
    1. According to the Tenth amendment to the United States Constitution, any power not given to the federal government through the constitution, is reserved to the states respectively. The Constitution as it stands, does not give the government authority to force a state to allow illegal immigrants to reside in its own state respectively
    2. The Supremacy Clause is about the Federal Government being able to make treaties with foreign countries and requiring the recognition of these treaties in all states within the union. There is no treaty that requires a state to allow illegal immigrants to stay within its own state, so this point is null.
  2. The second point in the challenge starts by reading “In our constitutional system, the federal government has preeminent authority to regulate immigration matters. This authority derives from the United States Constitution and numerous acts of Congress.”
    1. This is incorrect; however, in United States Code Title 8,1227, there is a list of deportable offences. These include criminal offences, entering the country under false pretences, and falsifying documents. According to the Act to Establish the Department of Justice, they are required to ensure that states enforce federal law.
  3. When reading more into the second the phrase “Although states may exercise their police power in a manner that has an incidental or indirect effect on aliens, a state may not establish its own immigration policy or enforce state laws in a manner that interferes with the federal immigration laws.”
    1. S.B. 1070 starts by stating “The legislature finds that there is a compelling interest in the cooperative enforcement of federal immigration laws throughout all of Arizona. ” The bill states from the very beginning that it is not creating a new law, but creating a way to enforce the laws that are already in place.
    2. Also S.B. 1070 refers to “cooperative enforcement.” This could be referring to enactments from the department of homeland security that can be found here. Within this fact sheet it talks about cooperation with state and local authorities to enforce federal immigration laws. S.B. 1070 is attempting to work with the DHS not work against it.


School out of control 11/23/2009

This has to be the first time in my experience that I am fully agreeing with something the ACLU is doing.


Smith-Green Community School Corporation and Churubusco High School Principal Austin Couch suspended two indiana teenagers athletic privileges for putting racy pictures of themselves on Myspace.

According to the school district policy they violated the terms of their athletic agreement.

The two teenagers have apparently gotten a lawyer from the American Civil Liberties Union, and are now suing the school district for violating the first amendment.  I say more power to them, and this is why.

The public school system has gotten out of hand.  From my personal experience, the school interferes with things that are not within their jurisdiction.  My evidence is from what was done to me.  I was sent to a mental institution for becoming suicidal (btw I was on Topamax a drug for migraines in which it was recently released that it is prone to causing people to become suicidal) , and then before I could return to the school, rumors were created that I was planning on my own school shootout.  I was suspended from all school activities for three weeks.  A bit harsh right?

I sent my complaints to the school board, and was refused any type of hearing to get me back in school.  When I contacted them, they would not give me a moment to plead my case and just told me to contact my principal and work through her.  When I talked to my principal, I found out that it is not considered a suspension because they assigned me a homebound teacher.  I will say that I got along with this teacher, but she was trained to teach homebound kids from middle school.  She had no experience in any of the subjects I was taking because I was taking all higher level courses, AP courses, and duel enrollment through the community college.

I was not allowed to attend class for a total of three weeks after I was in an institution for a week mostly because of a migraine medication I was on.  This was becoming absolutely ridiculous.  I was never able to improve on my grades in my physics class, so I finished the year with a D+ because there were some vital concepts that I was never able to understand that my teacher went over while I was out of class.  I had to drop AP European history because of inability to work with the teacher.  Because of these two grades dropping, I was not able to stay in Beta Club that would have given me a very good scholarship to the college I am at now.  I lost a very good friend of mine because I said things during the time that I was suicidal that I still wish I could take back.  I was unable to be a part of any of my senior year band competitions because of the timing I was out of class.

All this because of a medication, and an administration refusing to hear my case.  There must be something done about this system.  Anyone who reads this hear my plea.

The government has got to get out of our schools, or else more people are going to end up like I did.  Petition the government to redress grievances in our schools.

Obama to Address Public Schools 09/07/2009

Obama plans to address public schools across the nation tomorrow, and this frightens me.  One of the reasons this frightens me is because of the assignments many of the teachers in these schools are required to be handing out.  Things like “How do you think President Obama will inspire you today?”  is just one example of a scary topic.  If I were to try to write an answer to that ridiculous question, I would probably write about how President Obama will probably be trying to convince me that he is right about everything, and that he will push is extreme left-wing views on me and my classmates.

I am worried for these students, because they may not have anywhere to turn towards.  The students that do not want to watch the speech will probably be punished, and those that do not want to watch it but do anyways,  will be punished for not being inspired.  How can this be viewed as a good thing for schools in any sense?

I will be watching the speech tomorrow, and I will not let any single word he says be taken light heartedly.  I encourage everyone that reads this to be sure to do the same.

The truth must prevail, or lies will take us over.


More Governmental Interference 08/08/2009

Ok, there has been some resent speculation about what can happen if the government continues the path it is on.  What would happen if the health care bill goes through?  What would happen if the Cap and Trade bill takes over America?  What would happen if nothing is done?  Let me take a small stab at answering those questions.

For my answer to the first question, “What would happen if the health care bill goes through?” let’s start by examining the first part of the bill:

“A Bill, to provide quality affordable health care for all Americans and reduce spending, and for other purposes.”

What does that mean? “To provide quality affordable health insurance for all Americans.”   Quality Health insurance according to this bill means, providing full coverage insurance, including preventative care.  Doesn’t sound to bad yet, right?  Now what about the phrase “for all Americans”? Well when one reads into the fine print of who gets covered, it includes anyone in America older then 1 and younger then 65.  This includes natural born citizens, legal immigrants, and illegal immigrants.  Sounding a bit overly generous yet?  Or is it sounding scary?  Yes, your taxpayer money is going straight to people who don’t pay taxes.

Now what about the phrase to “reduce spending”? This bill will cost about a trillion dollars per year.  That is on top of the massive deficit that the government already has.  This is not saving money, it is spending more money we do not have.

Now the scariest phrase of all “and for other purposes”  This phrase means the government is hiding other things in the bill, and it gives them the freedom to do things that have nothing to do with health care at all.  One such thing is a program that is going into affect, with the bill, that forces all schools to create internal health assistance clinics for children within every school.  The clinics are required to provide health care for all students, and the clinics are required to keep complete privacy from parents unless students allow otherwise.  So what about getting to choose your family doctor? Now the children will be required to only see the doctors that the school and the government provides.

That is just the beginning of what will happen when the government takes over health care.  I have not talked about how the money is going to be spent, or the fact that there is a limit on how much money will be payed per household a year for coverage.  This bill is terrifying.  How it is even being considered is beyond me.

Now for the second bill, “to create clean energy jobs, achieve energy independence, reduce global warming pollution and transition to a clean energy economy.”  This bill is commonly known as the Cap and Trade Bill. It is also known as the largest tax increase in the history of America.

I cannot begin to talk about all of the things that this bill does, because every time this bill is reviewed by a different section of congress, things get added and taken out.

So, let me begin by breaking down this heading and showing how the things it claims already are incorrect.  “to create clean energy jobs.”  This means that any dirty energy job will be removed, such as coal or natural gas, and new jobs should be created with doing things like construction work.  The construction work I am referring to is building energy efficient homes (that the government will own), and building solar, water, and wind energy plants (also controlled by the government).

Now for the idea of Energy Independence.  What that translates in this bill can be found just by looking at sec. 495 of the bill.  In that section, it talks about how the USAID will have permission to use as much resources as the USAID  deems necessary to use for any reason dealing with the “most vulnerable developing countries.” It gives the USAID permission to impact/assist them with: “water availability, agricultural productivity, flood risk, coastal resources, timing of seasons, biodiversity, economic livelihood, health, human migration, or other social, economic, political, cultural, or environmental matters.” (What a long way to say that USAID can do anything they want!) That is what the government thinks energy independence is.  Not depending on others, but allowing others to depend on us.  This also combines with the health care bill, allowing our medical resources to be used to assist other countries, even when our medical resources are not enough to sustain ourselves.

“To reduce global warming.”  What a load of crock! The government doesn’t really care about global warming.  They just want a way to tax Americans the rest of their freedoms away.  Take for example from the bill.  Title VII spends a lot of time claiming to have discovered that “[G]lobal warming poses a significant threat to the national security, economic, public health and welfare, and environment of the United States, as well as other nations.”  They defend these claims by stating that the “Intergovernmental Panel on Climate Change and the National Academy of Sciences” have informed them.  Have you heard much about these organizations?  There is a link on the NAS website about images and charts taken from classified data about the Arctic Sea.  The claim by some is that these images help to prove Global Warming.  My question is why are these charts and images not released in an attempt to prevent incorrect speculation.  This makes me wonder if they are attempting to hide something.  There are other cases similar to this that have been found, but I do not have space to list them here.  If you want to find out more, you should check out the website  (http://www.nasonline.org/site/PageServer).

Transition to a clean energy economy.  This basically means that the government has control of what kind of energy and how much energy you are allowed to use.  The government has already decided to spend taxpayer money on getting rid of high millage vehicles, and if this bill is in place, the government will be able to force consumers to own the cars that the government wants citizens to own.   It also controls coal industries and natural gas drilling, which will force many businesses to shut down, and costing thousands, likely millions of jobs.

Now that I have explained what will happen immediately, lets begin some speculation on what will probably happen later.  Lets review for a moment on the things I have already written.  The government controls who lives and who dies.  The government controls who gets what.  What is the difference between this and Socialism?  Not a very big one.  What will happen is revolution.  The American people will not stand for this, and should not stand for this.

To answer my question from earlier “what if nothing is done?” Is very simple to answer.  Something will be done.  Either Americans will begin to fight for their lives, or the government will stand down and remember to represent that people.  I pray that before the end Americans will be ready to shout the famous words of Patrick Henry

I know this is not a very long post, but this is something that has begun to creep into my mind more and more often. What is America? I know that we say we stand for freedom and justice, but is that what we stand for?
I am an American, but what does that mean. Does it mean that I believe that our country does everything correctly? Does it mean that I will support my government in everything that is done?
The answer to these questions is NO!!!
When I say I am an American, I mean I believe that I can decide what is best for my family. It means that I do not need the government to tell me what I should or should not do. It means that I will not let others be blinded by what is happening. It means that I can do what I believe is right and best for me and my family. And there is not a thing that the government can do to keep me from doing what I believe is right.

I will be free from government, and free from those that wish to control my life.  Because I am an American!

Cass Sunstein 07/14/2009

Who is Cass Sunstein? What is his purpose? Why do his books cause so much controversy?

Cass Sunstein is a Harvard Law School Magna Cum Laude graduate who has published a handful of books.  He has is currently teaching at Harvard Law School.

Cass Sunstein wants to allow the government to have more control over our daily lives.

Cass Sunstein pushes this idea through his books.  Throughout his books he talks about how the Government should “nudge” people in the right direction.

What else do we know about him?  Not much except that Obama has placed him at the head of the White House Office of Information and Regulatory Affairs.  He now oversees many different organizations such as the Environmental Protection Agency and the Occupational Safety and Health Administration.

So, what is the problem? Obama has now put someone that believes in enhanced governmental control in charge of two of the largest regulatory agencies in America.  If he follows through on the things that he writes about in his books, Obama’s administration will soon have more power then a ancient Egyptian Pharaoh.

Sotomayor 2nd Amendment 07/14/2009

The new Supreme Court nominee Judge Sotomayor has been questioned about her view of the second Amendment of the United States Constitution.  According to a case DC v. Heller, Sotomayor judged that states have the right to control firearms that have nothing to do with militia.

The second amendment reads:

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

The idea that Nunchaku could be banned from New York was used in her case to say that firearms could be regulated.

I am no lawyer, but I believe that when something that says “the right of people to keep and bear arms, shall not be infringed,” means that they will not be infringed (or regulated). I shall be posting more on Sotomayor as she continues to be interviewed.
